These Terms of Service constitute a legally binding agreement between you and Emplyra (AIM Group Global). By accessing or using our platform, you agree to be bound by these terms.
1. Acceptance of Terms
By registering for, accessing, or using the Emplyra platform (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").
2. Description of Service
Emplyra provides a comprehensive HR and attendance management platform that includes, but is not limited to:
- Face recognition and GPS-based attendance tracking
- Employee shift scheduling and management
- Payroll processing and automation
- HR management tools (employee database, leave management, performance reviews)
- Analytics and reporting dashboards
3. User Accounts
To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials. Emplyra is not liable for any loss or damage arising from your failure to protect your account credentials.
4. Subscription and Billing
We offer multiple subscription plans (Basic, Growth, Scale). Subscriptions are billed monthly or annually as selected. All fees are non-refundable except as required by law.
5. Free Trial
New customers may be eligible for a 7-day free trial. At the end of the trial, you must subscribe to continue using the Service.
6. Acceptable Use Policy
You agree not to use the Service for any illegal purpose, attempt to gain unauthorized access, interfere with the Service, or violate any laws. Violation may result in immediate termination.
7. Data Ownership and Privacy
You retain all ownership rights to the data you submit. Our Privacy Policy explains how we collect, use, and protect your personal information.
8. Intellectual Property
The Emplyra platform is the exclusive property of AIM Group Global. You may not copy, modify, or distribute any part of the Service without our prior written consent.
9. Termination
You may cancel your subscription at any time. We may terminate your account for violation of these Terms or non-payment.
10. Limitation of Liability
The Service is provided "as is". Emplyra is not liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
11. Governing Law
These Terms shall be governed by the laws of Nepal. Any disputes shall be resolved through binding arbitration in Kathmandu, Nepal.
